| Contract of Sale and Guarantee Mystical Purr Cattery Breeder/Seller: Purchaser: Juan Fuentes __________________________ Mission, TX 78516 __________________________ (956) 884-9288 __________________________ www.Mysticalpurrcattery.com __________________________ The purchaser agrees to the following agreement made on this _____ day of __________ of _______ between Juan Fuentes (Breeder) and (Purchaser). The kitten/cat purchase price is $_______ without breeding rights or $_______ with breeding rights, plus shipping of $_______ less deposit of $_______. The balance of $_______ shall be paid in cash, USPS money order, western union or money gram. If kitten is to be shipped, payment in full is required prior to any shipping arrangements. Transactions are non-refundable if buyer changes his/her mind. Credit will be applied to another kitten of your choice if for some reason Breeder is not able to place agreed upon cat/kitten with Purchaser. Our goal is to place the right cat/kitten in the right home. We reserve the right to refuse the sale of any cat/kitten at any time and without reason. If the sale of such cat/kitten is declined, Breeder will return the Purchaser’s deposit if any exists. If any dispute arises based upon this contract, such dispute shall be resolved within the courts of Hidalgo County, Texas. 2. This cat/kitten is warranted to be in good health to the best of the Breeder’s knowledge. It is recommended that the Purchaser have the kitten/cat examined by a veterinarian within 72 hours of purchase at Purchaser’s own expense. Any health problems of a life threatening and untreatable nature shall be documented by the veterinarian and reported to the Breeder immediately at which time a second opinion may be requested by Breeder. A replacement will be offered upon the return of the cat/kitten accompanied with veterinarian report pending the results of the above mentioned by both veterinarians. In the event of an out of state sale, the Purchaser is responsible for expenses in return shipment of said cat/kitten. Any health problems after 72 hours shall be the responsibility of the Purchaser. Kittens are de-wormed twice between 6 to 9 weeks of age; vaccines for Rhinotrachietis, calici and panleukopenia will be administered before shipment. FIV and FeLV vaccines are not recommended. Please do not over vaccinate your cat/kitten. Kittens will need a booster shot at 16 weeks and a rabies shot is also recommended. We do not recommend FIP vaccination. Administration of the FIP vaccination will void all warranties. Failure to have the kitten/cat checked with vet within 72 hour time period makes all warranties null and void. Mystical Purr Cattery is not responsible for any veterinarian costs. 3. Under no circumstances after 72 hours of purchase will Breeder be obligated to allow kitten to be returned. However, if kitten should die from a genetic defect within one year of birth, Breeder will replace with cat/kitten that Breeder deems to be of equal value and quality as soon as one becomes available. A detailed necropsy report from a licensed veterinarian as proof of death from a defect will be required to be provided by Purchaser to the Breeder at Purchaser’s cost. This replacement guarantee includes PKD, FIP, and genetic defects that result in death before one year of age. 4. Breeder does not guarantee against treatable nuisances such as fleas, fungus, mites, worms or upper respiratory infections which are not life threatening. These are very treatable and common conditions in the breed and can be brought on by stress that the Breeder feels unable to guarantee against them but take all preventative measures to insure cats/kittens are free from. 5. Cats/kittens sold as pets do not have breeding rights and must not be bred. 6. It is strongly encouraged that the cat/kitten should not be declawed, as it is a mutilation and not considered good for the cat. 7. Purchaser agrees not to let the cat/kitten roam outdoors. 8. Purchaser agrees not to sell or give away cat/kitten to animal shelter, pound, pet store, and/or laboratory. 9. Purchaser assumes full responsibility for the cat/kitten upon leaving Breeder’s premises. 10. We feel it is important to isolate you cat/kitten for a few days to a week and give it time to adjust to the new environment before introducing other pets and to imprint where the litter box will be kept. Moving to a new home can be stressful to a pet and isolating them in their own room helps to acclimate them to their new surroundings. 11. We want to be sure our babies are doing well in their new homes and we will check on them via e-mail. Please feel free to contact us with any questions or concerns about your kitty. 12. This agreement shall be construed under and in accordance with the laws of the state of Texas and all obligations of the parties created here under are performable in the County of Hidalgo, State of Texas. This contract of sale agreement constitutes the entire agreement between the Breeder and Purchaser.
